This will be my last serious contribution to this thread since nobody else seems to be engaging this topic factually.
Activision/RO allege that the TAC boxes cause confusion for their customers and that trademarks are violated. So TAC has a box that refers generically to a "guitar game", in this case Guitar Hero. What else would you have them say to avoid mentioning Guitar Hero by name but still convey that this is a guitar controller for a guitar game? There is really only one guitar game that is known by the mainstream, and it sure as heck isn't Gitaroo-Man or Guitar Freaks.
As far as the Shredder comment goes, "shredder" is a common word that refers to a character, a boarder, a guitarist, and a thing for cutting paper. As such, it would only really be trademark infringement if it were mentioned on the box in the context of a ninja character. This is opposed to a fictional word or name such as Skywalker that has no common word origin and cannot be used in other contexts as a result.
Also, I checked out my TAC Wireless V box when I got home last night and found on it a rather large sticker that does state Guitar Hero by name but then also states that Guitar Hero is a trademark of RedOctane.
Personally, I think RO is trying to clear the shelves of the Wireless V in anticipation of their own wireless controller launch. My hope is that the courts will only go so far as requiring TAC to modify their packaging, a move that shouldn't require a recall of product, the destruction of the hardware, or the surrendering of profits. _________________

In addition to the counter claim, TAC has filed for a preliminary injunction asking the federal court to enjoin Activision and RedOctane from further infringing on the trade dress originally developed by Topway. The injunction also asks the court to allow for fair competition in the market by enjoining the sale of the game/controller âbundleâ so that consumers no longer have to purchase both the Guitar Hero game and the RedOctane controller but rather may purchase the game and have their choice on which controller to buy. To date, no injunction against TAC has been filed in this matter.
Topway originally designed and manufactured the Magical Guitar, a guitar controller for use with PlayStation® in 1999. TAC alleges in its cross complaint, among other things, that RedOctane purchased several hundred of the Magical Guitars from Topway prior to producing the controllers themselves. Furthermore, the cross complaint alleges that top management at RedOctane visited the Topway factory on numerous occasions and specifically inquired about Topwayâs trade dress design.
Hong Lip Yow, owner of The Ant Commandos, Inc., says TAC will continue to design, manufacture, and distribute The Guitar Mania Line despite the original claims filed by Activision Publishing, Inc. and RedOctane, Inc.
âTAC will continue to make and improve on innovative peripherals to provide gamers with a choice. I strongly believe consumers should have their own choice, especially when it comes to choosing a better quality and better designed product,â Hong Lip Yow stated.

Well, that's silly. I hope RedOctane gets served by Topway becasue of this, to be honest. It's so terrible hypocritical, it bugs me. At least TAC is getting publicity. |

No idea about TAC but RO makes crap tastic DDR hard pads... so I can really say the quality of their DDR pads are crap... look at those After Burners and how often they stop working... I think Red Octane deserves to lose this. They got too rich off their DDR pads and now they are corrupt... may they burn in hell |

You think the main topic is irony, this is actually turning out to be a selling point for TAC for people to buy and try out the controllers, thats double irony dont you think?.......if Red Octane lose, TAC will be loaded......get ready for the THIRD guitar simulator game....hey why not, theres 10 differant DDR clones out there (little exaggeration but you get the point). _________________
