This however is probably an unacceptable use of a IIDX machine. But since it's just one machine being operated by one person (perhaps privately), Konami isn't going to take action. For that same reason, this guy is safe. However, he definitely should not consider a buissness of selling kits to build those nor should he offer to build them for other people.

I know this is a while back, but I just wanted to say that I see these all over Tokyo. My favorite is the popin music set up like this. They do it to save space in the game centers. Its perfectly fine.

LMAO @ people who would have the audacity, poor taste, and a fundamentally flawed ability to draw meaningful critical comparisons to shamelessly liken Roxor to the revolution of the American colonies. Sorry, Kiba. FHOD's comment was stupid, but your response was rediculuos. (I hope most of the follow-up comparisons really were only in mock of that point.) Honestly...some people are too emotionally invested in dance games.

Wow way to TOTALLY miss the point of the entire gimmick, jesus.

The law requires three factors to make a case for contributory infringement; (1) a sale, (2) of a material component of a patented invention, and (3) knowledge that such component has been especially made for use in the infringement of a patented invention.

Roxor is clearly in violation of (1), and a case could be made for (3). Konami will likely argue that the "arrow scrolling" gameplay constitutes (2).

So, the heart of this lawsuit is whether the arrow scrolling dance sim genre is legally patentable or whether Konami's patent only extends to DDR in particular.

But they've already semi-lost that argument, and will loose the argument if they press it and RoXoR actually feels like persuing it.

If they can't prove that they own the "up, down, left, right arrow scrolling dance game" (which is the only real hand-hold they have, since they haven't defended their IP against PIU in the US recently) then they can't prove there's a patent infingement, because a hardware modification of a private cabinet does not infringe on Konami's right to manufacture and sell their cabinets.

So, to some extent, it doesn't have anything to do with the cabinet, it has to do with the game itself.

And the side suit for the trademark infringement, which (as I previously mentioned) I can sympathize with.

I personally think it's just a scare tactic and/or a marketing tactic to put them in a holding pattern for E3, in conjuction with them releasing the Extreme 2/Ultramix 3 news.

Should be interesting either way.

Kiba, you may have been trying to point out the stupidity of FHOD's comment with a comparison meant to reflect that back to him, but still, the very idea of likening Roxor to a fight for independence from another sovereign nation just immediately hit me the wrong way. Roxor is NOT a revolution of anything. They're not "fighting tyranny." They're a business (not a charity) just like Konami, only much smaller right now. I see no real "nobility" in what they have done (i.e. develop ITG), I'm sorry to say, at least no where near the level implied, though admittedly not necessarily meant, by your comparison. The banal fanboyism on both sides have seriously shortened my fuse.

It was more appropriate then pointing out the error in the reasoning of the post I was quoting, which I would have been unable to do in the spirit of good humor. People following after me just shows a spirit of good community.

I apologize then for the mis-implication, I meant no seriousness in the analogy - indeed quite the opposite, since the content of the irony in the post was reductio ad absurdum.

You mean it would have been less appropriate to try something akin to:

"FHOD, please refrain from posting thoughtless fanboyish, off-the-cuff remarks. There is a strong and growing fanbase of ITG players, many of whom post in this form and this very topic. The Konami vs. Roxor lawsuit is a volatile issue, and emotions are running high on both sides. Please learn to respect the fact that we all have different tastes. Roxor's current plight does not bode well for the future of a game many have taken a strong liking to, so give them a little room, ok?"

EDIT: Posted after Kiba further edited the post above. Thank you for seeing my point.

That wasn't what I meant, that would not have had the same content as what I posted. The point was to point out the formal error in the post, not the content of it.
