If you read that "Legal FAQ" that was posted on BemaniStyle a while back, said FAQ was completely bogus, as admitted to by its original author.
No one is in legal danger.... DDR-UK went down voluntarily after they got an email from the IFPI asking about some of the material on the site. That's all. It wasn't even a cease-and-desist order, just a question.
Likely DDR-UK is waiting for the heat to blow over, and then they'll come back up. _________________

But now the question is, when/ if they come back up will they have the official song mixes on them, and will there be a charge to download them. _________________

DDRUK would have to start paying royalties to Konami and other licensed artists because selling simfiles for one's own profit is illegal, and I doubt very much that DDRUK would find that the least bit fruitful; people just don't want to pay for things. |

I'm still really nervous. 'Cause I downloaded some songs for 6th Mix and Max. (period) But if DDR UK said that no legal actions are being taken, then I'm feeling better ..for now. |

You know...if you're nervous admitting you downloaded songs probably isn't the best way to make yourself feel better. _________________

Because if they went to any other site chances are they'd see some talk about mp3s and how downloading copyrighted material is illegal. Then they'd have to prove that the person doesn't watch the news. Then they'd have to prove that the person lived in a cave, because OF COURSE PEOPLE KNOW IT'S ILLEGAL. Maybe a couple years ago you could say you didn't know, but now? Come on. |
In fact, you wouldn't have to prove any of that. The prosocution would have to prove that you *did* do all of that. Which they also can't do. Hence why legal disclaimers about downloading copyright material are on pretty much every warez host. It allows them to say, "Well, we told them not to download it unless they owned a legal copy. It was only up there for legal owners of the software to get a look at how different kinds of protection schemes can work. It's *right there* on the site."
Almost every case of filesharers being prosocuted was waged because a) they were sharing a huge amount of copywrited material (generally tens of thousands of songs and/or hundreds of movies), and pretty much all of them got a cease and desist letter from the RIAA's lawyers *before* prosocution began. There have been exceptions, but the fact of the matter is, it's very difficult and also not economical to prosocute downloaders because there isn't enough court time to take several million people to court.
Whoever mentioned the drug dealer analogy earlier was correct. It's the uploaders who are always hit first. And even then, if they shut down voluntarily, those suits are generally dropped as well. So nobody has anything to worry about. Calm down. _________________
